Req. #1 1763 I N I T I A L 37436 RESOLUTION NO. L.I.D. No. 8651 2 A RESOLUTION related to public works and improvements; declaring the 3 City's intent to construct certain public works and improvements, and to form Local Improvement District in order to partially finance the costs 4 of the improvements, and setting a date for a public hearing. 5 BE IT RESOLVED BY THE COUNCIL OF THE CITY OF TACOMA: 6 Section 1. That the City Council intends to order the local improvement 7 described below and to pay the cost of such improvement by imposing and collecting 8 special assessments upon the real property that will receive special benefit from the 9 improvements; 10 Section 2. That the improvements shall consist of establishing grades and 1 1 1 2 placing thereon permanent pavement, cement concrete curbs and gutters and with 1 3 associative storm drainage as needed, and other improvements appurtenant thereto, 14 where needed, in: 1 5 (Segment #1) North 29th Street from Proctor Street to Monroe Street (Segment #2) North 28th Street from Union Avenue to Washington Street 1 6 (Segment #3) Verde Street from North 36th Street to North 37th Street 1 7 (Segment #4) Whitman Street from North 37th Street to North 40th Street (Segment #5) South 94th Street from Alaska St west to the dead end 18 The improvements may include driveway entrances; sanitary sewer connections 19 from the sewer main to the property line; the removal and planting of trees, and all work necessary to complete the improvements in full accordance with the plans and 20 specifications to be prepared by the City Engineer. 24 Section 3. That actual assessments may vary from assessment estimates, so 8 long as the assessments do not exceed the increased true and fair value the 9 improvement adds to the property being assessed. At the option of the property 10 owners, the assessments levied against the property shall become due and payable I 1 in cash, without interest, within thirty days after publication of notice of assessment, 12 13 or in ten (1 0) equal annual installments with interest on deferred payments at a rate 14 to be hereafter fixed, but in no event greater than one-half percent above the rate of 15 interest fixed upon sale of bonds for the district. 16 Section 5. That the Hearing Examiner of the City of Tacoma shall conduct a 17 hearing to consider the creation of the proposed local improvement district described 18 herein. This hearing shall be held in the City Council Chambers on the first floor in 19 the Tacoma Municipal Building, at 747 Market Street, on April 28, 2008 at 5:00 p.m. 20 That all persons who wish to object to the making of the improvement or formation of 21 the local improvement district shall do so in writing and must file such objection with 22 23 the City Clerk before 5:00 p.m. on Monday, April 28, 2008. Any person who wishes 24 to comment on or object to the making of the improvement or formation of the local 25 improvement district may also appear and present their comments or objections at 26 the hearing. resl 1763.doc-sig/tok -3 40 LEG 004 (11/89) Section 6. That the Director of the Public Works Department shall submit to I he Hearing Examiner, at a date prior to April 28, 2008, the estimated cost of the 2 3 mprovement; a statement of the proportionate amount thereof that should be borne 4 y the property within the proposed local improvement district; a statement of the 5 aggregate actual value of the real estate, including 25 percent of the actual value of 6 the improvements thereon, within the district according to the valuation last placed 7 upon it for the purpose of general taxation; a statement, in detail, of the local 8 improvement assessments outstanding and unpaid against the property within the 9 district, together with a diagram or print showing the lots, tracts, and parcels of land 10 hat will be specially benefited by the improvement; and the estimated amount of the I 1 cost and expense of the improvement to be borne by each parcel of property. 12 1 3 Section 7. The City Clerk shall publish this resolution in the official 14 newspaper of the City of Tacoma, as required by law. 15 Section 8.
