ORDINANCE NO. 26829
AN ORDINANCE granting a non-exclusive Franchise to the Pierce Transit
Authority ("Pierce Transit"), a Public Transit Benefit Area Authority
2 organized under the laws of the state of Washington, to construct, install,
operate, own, control, repair, and maintain bus shelters within the City of
3 Tacoma, and setting forth provisions, terms, and conditions of the grant of a
4 franchise under the Tacoma Municipal Code and the City of Tacoma
Charter.

WHEREAS Pierce Transit is a Public Transit Benefit Area Authority,

7 established under RCW 36.57A, vested with the powers necessary to construct
8 and operate a public transportation system benefiting Pierce County residents,
9 and
WHEREAS the City of Tacoma is a first-class city operating under the
laws of the state of Washington, and

1 3 WHEREAS the City owns and operates streets, public utilities, and other
1 4 infrastructure improvements within the City boundaries, where transit
15 improvements are proposed; Now, Therefore,

BE IT ORDAINED BY THE CITY OF TACOMA:

18 That, in consideration of mutual promises and covenants herein
19 contained, to be kept, performed, and fulfilled by the respective parties hereto,
20 it is mutually agreed that a Franchise is hereby granted to Pierce Transit, a
21 government authority organized under the laws of the state of Washington
